The U.S. Food and Drug Administration exercises jurisdiction over drugs, biologics, and related products under the Federal Food, Drug, and Cosmetic Act (FD&C Act). The majority of research peptides are unapproved for human or veterinary therapeutic use; they have not undergone FDA review or received marketing authorization. Offering an unapproved product with claims that it diagnoses, treats, or prevents a disease, or that it is intended for human administration, may render it a misbranded or unapproved new drug in violation of federal law.
Entities that manufacture, repackage, relabel, or distribute certain drug products may be required to register their establishment and list their products with the FDA. These obligations are discharged exclusively through the FDA's own electronic registration systems.
Compounds classified as controlled substances under the Controlled Substances Act (CSA) require separate registration with the Drug Enforcement Administration. FDA registration does not satisfy DEA requirements, and DEA registration does not substitute for FDA obligations. Distributors handling scheduled compounds must verify their classification status and obtain the corresponding DEA registration.
The regulatory classification of a product is determined in significant part by its labeling and the claims made about it. Products designated for research use only must be labeled and marketed exclusively as such. Any express or implied claim of therapeutic benefit, human applicability, or disease treatment will subject the product to regulation as a drug and may expose the distributor to enforcement action.
